CLASSIFICATION FOR REGISTERING DESIGN (LOCARNO CLASSIFICATION)
Viet Nam applied the Locarno Classification under the Locarno Agreement Establishing an International Classification for Industrial Designs for design applications.
PROCEDURE FOR AMENDMENT OF INDUSTRIAL DESIGN APPLICATIONS
Before the IPVN issues decisions on rejection of an application, decisions on refusal to grant a protection title or decisions on the grant of a protection title, the applicant may amend of the application on his/her own initiative or upon the request of the IPVN.
PROCEDURE FOR TRANSFER OF INDUSTRIAL DESIGN APPLICATIONS
Before the IPVN issues decisions on rejection of an application, decisions on refusal to grant a protection title or decisions on the grant of a protection title, an applicant may request the IPVN to record the transfer of his/her application to another person
FORMS OF INDUSTRIAL DESIGN
Industrial design means a specific appearance of a product embodied by three-dimensional configurations, lines, colors, or a combination of these elements.
Products herein are understood to mean articles, tools, equipments, or parts used for assembling such products, manufactured by industrial or handicraft methods, with a structure and clear function, be circulated independently.
THE SUBJECT MATTERS SHALL NOT BE PROTECTED AS INDUSTRIAL DESIGNS
Industrial design means a specific appearance of a product embodied by three-dimensional configurations, lines, colors, or a combination of these elements.
TIME LIMIT OF INDUSTRIAL DESIGN PROTECTION
According to the IP Law 2005, amended 2019, the time limit of industrial designprotection as follows: Designs are protected for 5 years from the filing date or the priority date. The owner can renew their protection titles and there are 2 consecutive times of renewals.
DESIGN SEARCH SERVICE
Before registering a design, ensure that the design you created is different from with designs diclosed before, you should carry out searching design. Otherwise, your design application may face an opposition from the registered design owner or a refusal from the IPVN because of its novelty with the disclosed designs.
